Section 13 rent increase notice

The four timing rules Form 4A has to satisfy

Housing Act 1988, s.13(2)
  1. At least two months’ notice before the new rent starts. s.13(2)(a)
  2. The first increase cannot take effect in the first 52 weeks of the tenancy. s.13(2)(b)
  3. After that, at least 52 weeks between one increase taking effect and the next. s.13(2)(c)
  4. The new rent must start at the beginning of a period of the tenancy. s.13(2)

Two months is the notice period; 52 weeks is the spacing between increases — they are different clocks, not one long one. On a new tenancy the earliest a new rent can take effect is the end of week 52, so the notice for it is served around week 43 at the latest. It is never twelve months’ notice.
