Section 8 notice on Form 3A (2026): grounds, notice periods and the earliest court date

The short answer

How do I serve a valid Section 8 notice on Form 3A in England after 1 May 2026?

Since 1 May 2026 a landlord of an assured tenancy in England gets possession by serving a notice seeking possession on Form 3A under section 8 of the Housing Act 1988, relying on one or more grounds in Schedule 2, and, if the tenant stays, going to court. The notice must name every tenant, set out each ground in full with your explanation, and give the earliest date court proceedings can begin: the date after the longest notice period of the grounds you rely on (four months for selling or moving in, four weeks for rent arrears, two weeks for most breaches of the tenancy, and none for serious anti-social behaviour under Grounds 7A and 14). Proceedings must then start within 12 months of service.

Section 21 has gone

No-fault Section 21 notices ended for assured tenancies in England on 1 May 2026. A possession claim now starts with a Section 8 notice on the May 2026 Form 3A (the court can dispense with the notice only in narrow cases, never for Grounds 7A, 7B or 8). An older Form 3 is the wrong form.

Notice periods by ground

Four months: Grounds 1 (landlord or family moving in), 1A (selling), 1B, 2, 2ZA-2ZD, 4A, 6, 6A and 6B.

Two months: Grounds 5, 5A-5D, 5H, 7 and 9.

Four weeks: Grounds 5E-5G, 8 (serious rent arrears), 10, 11 and 18.

Two weeks: Grounds 4, 7B, 12, 13, 14ZA, 14A, 15 and 17.

None: Grounds 7A and 14 (serious anti-social behaviour and nuisance). Proceedings can begin the day the notice is served. Where 7A or 14 are the only grounds the court finds made out, an order cannot take effect within 14 days of service.

With several grounds, the date in question 2.1 has to satisfy the longest period, unless Ground 7A or 14 is one of them: then proceedings can begin on the day of service, even with other grounds alongside. Months run to the same date in the later month (or the 1st of the next month where that date does not exist), and the date in 2.1 is the day after the period ends.

What stops a notice working

An unprotected deposit or missing prescribed information: a court cannot make a possession order on any ground except 7A or 14 until it is put right (s.215 Housing Act 2004).

Ground 8 rent arrears below three months' rent (13 weeks' if rent is weekly or fortnightly) when the notice is served, or at the hearing.

Ground 1 inside the first year of the tenancy, or Ground 1A unless a compulsory acquisition notice has been given. After relying on either, from service until 12 months after the earliest court date that ground allows, you cannot re-let or market the property.

A tenant in a Breathing Space (Debt Respite Scheme): no notice on Grounds 8, 10 or 11 for rent arrears covered by the moratorium while it lasts, unless a court gives permission.

Serving later than planned: if the tenant receives the notice after the day you worked the date out from, the date in 2.1 may be too early. Work it out from the real date of service.

Email service where the written tenancy agreement does not provide for it. GOV.UK suggests handing it over, putting it through the letterbox or registered post. A posted notice is served when it arrives (unless your agreement has a notice clause), so allow for the post.

Proving you served it

Keep the notice exactly as served, and a dated record of how and when each tenant received it. The court's claim form asks for the date and method of service, and a certificate of service (Form N215) is the usual proof.

Questions landlords ask

How much notice do I give for rent arrears?
Four weeks on Grounds 8, 10 and 11. Ground 8 also needs at least three months' (13 weeks') rent unpaid both when you serve and at the hearing.
How much notice to sell or move in?
Four months on Ground 1A (sale) or Ground 1 (you or family moving in), and the date cannot fall within the first year of the tenancy.
How long is a Section 8 notice valid?
Court proceedings must begin within 12 months of the date the notice is served. A Breathing Space can extend that.
Can I serve a Section 8 notice by email?
Only if the written tenancy agreement provides for notices to be served by email. Otherwise serve by hand or post.
Does ServeProof fill Form 3A?
Yes. It fills the official GOV.UK Form 3A from your tenancy with the full wording of each ground, works out the dates, checks the bars above, and records service with proof. £49 per notice. It does not decide whether your ground is made out.
Is this legal advice?
No. It is a summary of the statute and GOV.UK guidance. Take advice on your own facts before relying on a ground, especially a discretionary one.
